This consent form is to provide you, the patient, with information about the medication, therapy, and case management services available at Gainful Pragmatic Solutions (GPS), which may be delivered both in-person and remotely. Understanding the nature of these services and their delivery methods is crucial for making an informed decision about your treatment. Please read this document carefully and discuss any questions or concerns with your GPS team .

1. Description of Treatment and Delivery Methods

Medication Management: Prescription and monitoring of medications, which can be discussed and managed through in-person visits or remotely via phone or video conferencing.

Therapy Services: Including individual, group, or cognitive-behavioral therapy, which can be conducted in-person or remotely.

Case Management Services: Involves assessment, planning, and coordination of care, available both in-person and through remote communication.

2. Modes of Treatment Delivery

In-Person Services: Offer the benefit of direct, face-to-face interaction and may be more suitable for certain types of assessments and interventions.

Remote Services (Telehealth): Include phone calls and video conferencing. These are convenient and can increase accessibility to services but may have limitations such as reduced personal interaction, potential technical issues, potential for misdiagnoses or inappropriate treatment due to inability to obtain certain information such as a physical exam and may not be suitable for all types of interventions or emergency situations.

3. Potential Benefits

Potential benefits of treatment at GPS may include improved symptom management and mental health, enhanced coping strategies and daily functioning, and accessibility and convenience of remote services. Your clinical team will discuss further benefits of therapy prior to starting therapy and your medical team will discuss benefits of medication or non-medication treatments prior to starting treatment.

4. Risks and Limitations

As with all treatment of health conditions, including mental health, there is a risk of worsening health. Providers at GPS are appropriately credentialed and experienced to provide care and we strive to provide safe, effective, timely, and compassionate care to all our patients. Medications and other forms of treatment may have inherent risks include adverse effects. There is a risk of emotional discomfort during visits; however, our medical and clinical providers are experienced and will work closely with your preferences for care to minimize this risk. Additionally, there are technical issues, privacy concerns, and potential limitations in the effectiveness of remote services compared to in-person services. Your clinical team will discuss further risks of therapy prior to starting therapy and your medical team will discuss risks of medication or non-medication treatments prior to starting treatment.

5. Alternatives to Treatment

6. Confidentiality and Records

All treatment records will be kept confidential and in compliance with HIPAA regulations. This includes both in-person and remote encounters.

7. Patient Rights

You have the right to inquire about any aspect of your treatment, refuse or stop treatment, and be informed about your progress. To exercise this right, please let your GPS team know.

8. Consent to Treatment

By using our services, you acknowledge that you have read and understood the information provided, had the opportunity to ask questions, and consent to the medication, therapy, and/or case management services, including their delivery through in-person and remote methods.

Consent to Telehealth

Introduction

Telemedicine involves the delivery of healthcare services using electronic communications, information technology or other means between a healthcare provider and a member who are not in the same physical location. Telemedicine may be used for diagnosis, treatment, follow-up and/or member education, and may include, but is not limited to:

Electronic transmission of medical records, photo images, personal health information or other data between a member and a provider;

Interactions between a member and provider via audio, video and/or data communications.

Use of output data from medical devices, sound, and video files.

The electronic systems used by Gainful Pragmatic Solutions (GPS) will incorporate network and software security protocols to protect the privacy and security of health information and imaging data, and will include measures to safeguard the data to ensure its integrity against intentional or unintentional corruption.

Possible Benefits of Telemedicine

Can be easier and more efficient for you to access medical care and treatment.

You can obtain medical care and treatment at times that are convenient for you.

You can interact with providers without the necessity of an in-office appointment.

Possible Risks of Telemedicine

Information transmitted to your provider(s) may not be sufficient to allow for appropriate decision making by the provider(s).

The potential inability of your provider(s) to conduct certain tests, assess vital signs in-person, conduct an in-person physical exam, or full visualize your body may in some cases prevent the provider(s) from providing a diagnosis or treatment or from identifying the need for emergency medical care or treatment for you.

Your provider may not be able to provide treatment for your particular condition via telemedicine and you may need to seek alternative care.

Delays in medical evaluation/treatment could occur due to failures of the technology.

Security protocols or safeguards could fail causing a breach of privacy.

Given regulatory requirements in certain jurisdictions, your provider(s) treatment options, especially pertaining to certain prescriptions may be limited.

By accepting this Consent to Telehealth, I acknowledge, understand, and agreement to the following:

I have read this Consent to Telehealth carefully and understand the risks and benefits of the use of telemedicine in the medical care and treatment provided to me through GPS platform by “Providers”.

I give my informed consent to the use of remote services by staff affiliated with GPS.

I understand that the delivery of healthcare services via telemedicine is an evolving field and that the use of telemedicine in my medical care and treatment may include uses of technology not specifically described in this consent.

I understand that while the use of telemedicine may provide potential benefits to me, as with any medical care service no such benefits or specific results can be guaranteed. My condition may not be cured or improved, and in some cases, may get worse.

I understand that “Providers” may determine in his or her sole discretion that my condition is not suitable for treatment using telemedicine, and that I may need to seek medical care and treatment in-person or from an alternative source.

I understand that the same confidentiality and privacy protections that apply to my other health care services also apply to these telemedicine services.

I understand that I have access to all of my health and wellness information pertaining to the telemedicine services in accordance with applicable laws and regulations.

I understand that if I choose to correspond to staff affiliated with GPS via a non-HIPAA compliant platform such as a personal email (e.g., Gmail, yahoo mail, etc..), my data and information is being transmitted via a fully HIPAA-compliant mechanism and thus there is risk for compromise or leak of my information. I also understand that HIPAA-compliant email options exist, and it is recommended that I use one to interact with GPS affiliates.

I understand that I can withhold or withdraw this consent at any time by informed my GPS team. Otherwise, this consent will be considered renewed upon each new telemedicine consultation with “Providers”.

I agree and authorize GPS and its affiliates to share information regarding my care with other individuals for treatment, payment, and healthcare operations purposes.

Patient Responsibilities

Patients are obliged to provide accurate health information and adhere to their prescribed treatment plans. This includes responsibilities related to scheduling, attending appointments, and timely communication for any necessary changes to appointments.

Financial Terms and Responsibilities

GPS provides clear and explicit information regarding billing, insurance policies, and payment requirements. Patients are responsible for comprehensively understanding their insurance plans, including co-pays, deductibles, and any additional expenses. GPS retains the right to modify its fee structures, ensuring that any changes are communicated effectively to patients. See “Financial Agreement” for more details.

Liability, Risk Acknowledgment, and Informed Consent

GPS maintains a safe environment, but we are not liable for typical business-related injuries, accidents, or harm. Recognizing the inherent risks in mental health treatment, including the possibility of misdiagnoses, adverse reactions to treatment, or potential deterioration in mental health, these risks are thoroughly communicated to patients before treatment, ensuring informed consent.

Service Termination

GPS reserves the right to terminate services under specific conditions including, but not limited to, non-compliance with treatment plans, repeated missed appointments, or if continuation of care is determined to be non-beneficial or harmful. The termination process will involve comprehensive communication and appropriate transition of care.

Governing Law, Arbitration, and Dispute Resolution

Governed by Arkansas law, disputes under these Terms shall be settled through a detailed binding arbitration process in Arkansas.
